Call for Protest Against Nuke Deal

Defend India’s Sovereignty on the Eve of the 60th Anniversary of Indian Independence ! Scrap Humiliating Indo-US Nuke Deal !

The corporate media is full of paeans of praise for the Indo-US Nuke Deal which according to them represents a brave new world of civilian nuclear technology “transfer” and “trade” between the U.S. and India. The ‘123 Agreement’ between India and the US is being discussed in Parliament today. What a shame that on the eve of the 60th anniversary of Indian Independence, the UPA Government is going all out bind India in perpetuity to a humiliating Deal that is a blot on India’s sovereignty and hard won Independence.

Let us recap what the Nuke Deal really implies for India:

· Threat of US disruption of fuel supply will affect India’ sovereignty: A key section of Article 5 of the 123 Agreement permits the United States unilaterally to disrupt future fuel supplies to India and the only consequence of such a disruption for the U.S. under this unequal agreement is that... it will convene a meeting of other NSG nations! India will be forced to bend to US’ dictates on foreign and domestic policy under threat of disruption of fuel supply.

· Threat of US Military Intervention in the Name of “Return’ of Materials: Even more dangerously, the agreement in Article 14 grants the U.S. a unilateral right at any date “to require the return by the other Party of any nuclear material, equipment, non-nuclear material of components transferred under this Agreement and any special fissionable materials produced through their use....

The “right of return” section even goes so far as to allow for “the removal from the territory or from the control of the other Party” of this equipment and materials rather than the return. Isn’t this a clear authorization of a physical military intervention by the US in India, in the name of confiscating equipments and materials?

· Nuke Deal is subservient to US Laws: Manmohan Singh claims that the Nuke Deal is an international treaty and so does not need ratification from Indian Parliament. But the United States Supreme Court has held that as a legislative act of the US, even one passed subsequent to a treaty, can override an international treaty! India’s 123 Agreement, unlike the parallel US Agreement with China, contains no safeguard against the over-riding of it by the US’ Hyde Act or any subsequent legislation. Contrast India’s 123 Agreement with Article 2.1 of the parallel agreement the United States negotiated with China in 1985 which states:

“The parties recognize, with respect to the observance of this agreement, the principle of international law that provides that a party may not invoke the provisions of its internal law as justification for its failure to perform a treaty.”

The U.S.-Indian agreement contains the identical language in its Article 2.1, except that the italicized sentence does not appear. The failure of the Indian negotiators to obtain recognition of the elementary international law principle that U.S. obligations under the treaty cannot be superseded by U.S. domestic legislation speaks only to a colonial lack of self-respect.

Clearly according to the Agreement, the U.S. openly gains the power to threaten to deny ongoing fuel supplies (and even the forcible removal of supplies previously given) in order to control future Indian policy. Is this a remote speculation? We must recall that in the 1970s the U.S. unilaterally cut off all fuel supply to Tarapur, in material violation of the previous “123” agreement between the U.S. and India of 1963.

But this is only one aspect of a larger issue. This deal is a part of an ongoing project to absorb India into the U.S. imperial sphere of influence as a “strategic” junior partner.

The recent case of the nuclear powered aircraft carrier Nimitz anchoring in Chennai port followed by the Joint U.S.-Indian naval exercises in the upcoming months in the Bay of Bengal point to increased US military presence on Indian soil. The reassurances from Manmohan’s men could not mask the real purpose of USS Nimitz’s presence in Asian waters—to threaten the Persian Gulf with its deadly cargo until war is declared on Iran.

Despite verbal fireworks in parliament, regimes dominated by both the BJP and by Congress have worked with equal commitment to render India a client to the US. Manmohan Singh has issued an insulting challenge to the CPI-CPI(M)-led Left supporters of the UPA Government, challenging them to withdraw support if they dare. His arrogance is emboldened by the fact that in the past three years, the Left, despite occasional barking, has never really applied a bite on the range of anti-people policies peddled by the UPA Government. In fact on matters like the Patents Act and the SEZ Act, the CPI-CPI(M) have cheerfully passed them in Parliament and have displayed full commitment to these Acts.

Will the CPI-CPI(M) fulfil the historic call of the martyrs of 1857 and of Bhagat Singh by going beyond lip service and dramatics, calling a halt to colonial subservience and ensuring the defeat of the Nuke Deal on the floor of Parliament? Will they give a fitting reply to Manmohan’s arrogance by withdrawing support from the UPA Government which has misled the nation and Parliament on the Nuke Deal? Will they expose the hypocrisy of BJP’s opposition to the Nuke Deal by showing up its pro-US colours? Or will it limit itself to a walk-out from Parliament that leaves the field free for the Nuke Deal to be passed? All this remains to be seen.

AISA calls upon JNU students to join a Protest Demo at Parliament Street tomorrow, demanding that Indian Parliament scrap the Nuke Deal. This demo is part of the all-India Protest being observed by the CPI(ML).

Against Arrest of Mohd. Haneef

28 July Leaflet

Shame on the Australian Government for Harassment of Dr. Haneef!

Resist Witch-hunt of Innocents in the Name of ‘War on Terror’ – be it in Australia or India!

The Australian Government has had to drop all charges against the Dr. Mohammed Haneef. The Australian Government, unable to face the outrage – in Australia and internationally – against the illegal detention of an obviously innocent man – has finally dropped its racist justifications for harassing Haneef, and has dropped all charges against him.

But many questions remain unanswered:

· Why did the Australian Government try to cook up a case against him based on the flimsy ground that he had given away his sim card to someone – that too, a sim card that had not even been used in the terror plot?

· Why did they cancel his visa after a magistrate had granted him bail, claiming that he ‘failed the character test’ for immigrants? Why do they continue to deny him his visa?

· Why did they try to leak false stories to the media, painting him as a terrorist?

· Who will be punished for subjecting an innocent man to this witch-hunt, and for casting false aspersions in public on his ‘character’?

The fact is that the US-led ‘War on Terror’ has become an excuse for the witch-hunt and violation of human rights of Muslims in the USA and Europe – through the use and abuse of a host of terror laws.

Haneef’s case is a reminder of the widespread Islamophobia and racist and communal witch-hunt against Muslims all over the world, and in India too.

The Indian Government and Indian media are full of self-righteous outrage against Haneef’s detention. But there are many Haneefs in India too – and barring a few high-profile cases, very few of them get justice.

· Remember S A R Geelani – he was accused of involvement in the Parliament Attack case on totally flimsy grounds – based on a single innocent phone conversation! He was tortured in jail and police custody; and even after he was exonerated by the Court, the Delhi Police engineered a nearly fatal attack on him. Even today, he lives in fear of his life.

· Remember Iftikar Geelani, the journalist, also falsely accused of being a terrorist? The police claimed to have found secret intelligence documents on his computer – but in Court, it was prove that those ‘secret’ documents are in fact freely available material on the internet! Then the police planted pornographic material in his home and tried to accuse him of peddling pornography!

· Mohammad Afzal still awaits justice in jail, with a death sentence hanging over his head. There is ample evidence that suggests that Afzal was a pawn in the Parliament attack case, and in fact that he acted under threats and coercion from STF officers. Yet, the real perpetrators of the Parliament Attack have never been identified – Afzal has been made a scapegoat and sentenced to death. India’s Supreme Court, as well as Indian media and most of the powerful political parties have been happy to remain silent and let Afzal die without even a fair trial.

Of course, that is not all.

· What about the hundreds of Sohrabuddins who are killed off in fake encounters and branded as ‘terrorists’ in death?

· Why is the Srikrishna Commission Report and recommendations never implemented ?

· Why do the Shiv Sena-RSS-BJP perpetrators of the 1993 Mumbai riots and the complicit police officers still go scot-free, despite being held guilty by the Commission?

· What explanation do the Congress govt. of Maharashtra and UPA govt., ruling in the name of “secularism”, have for such collusion with and protection to the communal marauders?

The democratic campaign for justice has paid off in Haneef’s case, and Haneef’s innocence stands vindicated – but this case must only remind us of the innocents whom we continue to condemn to torture and illegal imprisonment in the name of the war on terror!

US War on Terror Threatens Pakistan

Devil At Our Doorstep:

In The Name Of War on Terror US Enters the Subcontinent via Pakistan

Few can forget the threat issued in the wake of 9/11 by Richard Armitage, then US Secretary of State to Pakistan President Pervez Musharraf: “Join the War on Terror or be bombed back to the Stone Age.” That voice of a brazen bully echoes ironically in Pakistan today: in the hushed silence after the bloodshed at Lal Masjid, and in the blasts and a suicide bombing attack on a pro-democracy meeting that have followed in the wake of the Lal Masjid episode. The border tribal regions of Pakistan have also erupted in blasts in angry reaction to the Lal Masjid operation. And that in turn has led to fresh threats of US military strikes on Pakistan.

South Asian nations can see the proud historical civilisation of Baghdad being “bombed to the Stone Age”; to escape this fate, they must be prepared to bomb their own people into the Bush Age – a new age of Empire. Rulers of the subcontinent- both in India and Pakistan- have unfortunately been more than eager to prostrate themselves before the US in a craven effort to prove themselves as loyal warriors in the US’ holy crusade against terror.

The prompt US approval for ‘Operation Silence’ certainly seems to corroborate the idea that the Musharraf Government’s act of silencing the Masjid was at the behest of the US.

The question remains: was Operation Silence aimed at silencing ‘fundamentalist’ forces or was it to silence the criticism of Musharraf’s pro-US policies and derail the growing democratic resistance against his regime?

An American scholar who was visiting Pakistan at the time of the Lal Masjid episode has commented that “key social and economic aspects of the story were being overlooked” in the dominant discussion on the incident. He has pointed out that beyond the fundamentalist discourse, the Lal Masjid clergy had also articulated rhetoric against the corruption of the Pakistani military, political and economic elites, in contrast with the poverty and suffering of ordinary Pakistanis at the hands of the US-dominated neoliberal project. This rhetoric was no doubt part of the reason for its appeal: the residents of the Lal Masjid were overwhelmingly youth from the poorer sections of Pakistani society, who had found both home and identity in the Masjid.

It is significant that Rand, a global policy think tank offering research and analysis to the United States armed forces recently released a monograph titled “War and Escalation in South Asia” that stresses South Asia’s strategic importance and recommends stronger US military presence in the region. And undoubtedly Pakistan is the next outpost of the US ‘war on terror’: the US’ next target for military intervention after Iraq.

Recall that a doctored “intelligence report” was the basis for the war on Iraq. This time, a new “National Intelligence Estimate [NIE]” of the US has been released which claims that “the Al-Qaeda and its affiliates have sought safe haven in the Tribal Areas of Pakistan”. Bush, on the occasion of the release of this report, made the comparison with Iraq explicit. He repeated the tired lie that from Iraq to the tribal areas of Pakistan, they were all the same: “These people have sworn allegiance to the very same man who ordered the attack on September the 11th, 2001: Osama bin Laden. And they want us to leave parts of the world, like Iraq, so they can establish a safe haven from which to spread their poisonous ideology. And we are steadfast in our determination to not only protect the American people, but to protect these young democracies.”

A White House spokesperson Tony Snow made its clear that ‘protection’ of Pakistan was to be done much in the same way as Iraq has been ‘protected’ – by a military strike. He said, “We certainly do not rule out options, and we retain the option especially of striking actionable targets. But it is clearly of the utmost importance to go in there and deal with the problem in the tribal areas” even if it means violating the peace treaty with the tribal areas that is in place. (emphasis ours)

Branding a country/region as a ‘safe haven’ for terrorists in order to demand and justify “going in there” with military arsenal is an old familiar tactic for the US.

Assistant Secretary of State for South Asia Richard Boucher explained, “We have to remember that some military action is necessary, and will probably have to be taken, that there are elements in these areas that are extremely violent and are out to kill Government people, out to kill Government leaders, and will not settle for a peaceful way forward.”

The threat to Musharraf is: send in Pakistani troops or US troops will “go in there”. Of course they might “go in there” eventually anyway.

Many voices of experience within Pakistan have warned that the backlash to the Lal Masjid episode is a taste of what military intervention by Pakistani troops in such civilian areas would inevitably lead to. But the Musharraf regime, facing a crisis of credibility within Pakistani society, might well obey his US masters rather than risk incurring their wrath as well.

India, rather than rejoicing with smug claims that the Musharraf regime is reaping the terror crop that it sowed, should be warned. The Lal Masjid massacre is a sign of the US war on terror bullying and buying its way into the subcontinent. Already, the India’s waters have become arenas for joint military exercises with US warships. The Glasgow episode – or any other pretext – can be used to make India the next target of threats to comply – or else be bombed to the Stone Age. After India signs the Indo-US Nuke Deal, it will only seal its fate even more fully.

It is high time that the people of India unite for determined resistance against UPA’s increasing subservience to US diktats that is steadily strengthening its toehold in the subcontinent.
